Title, number of pages and language(s) of the notified document:  Draft Commission Decision amending, for the purposes of adapting to scientific and technical progress, the Annex to Directive 2002/95/EC of the European Parliament and of the Council as regards exemptions for applications containing lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls or polybrominated diphenyl ethers (11 pages, in English).

Description of content:  Through this draft Commission Decision, having carried out the requisite technical and scientific assessment, the Commission proposes to review exemptions added in the Annex to Directive 2002/95/EC through successive amendments since the entry into force of the substance ban (1 July 2006).

Objective and rationale, including the nature of urgent problems where applicable:  The draft Decision aims to adapt Directive 2002/95/EC to technical and scientific progress. According to Directive 2002/95/EC exemptions from the substance ban laid down in Article 4(1) of that Directive can be granted by the Commission when the elimination of substances from certain applications is technically or scientifically impracticable. The Commission has the obligation to review those exemptions at least every four years, with the purpose of deleting them, where substitution of substances in those applications has become practicable.
